What is Probate?

Probate is the process by which a court legally recognizes a person's death and authorizes the administration of their estate. In Texas, a person's estate is made up of their assets including real property (i.e. a home, mineral interests) and personal property (i.e. stocks, vehicles). Administration of the estate consists of management and distribution of the estate assets. The purpose of probate is to transfer the assets out of the name of the decedent and into the name of the beneficiaries or heirs.
